New York Asbestos Laws and Regulations

New York has passed numerous laws that regulate the manufacture, use, and distribution of asbestos products. Many of these laws focus on improving air quality, asbestos abatement, and litigation in state courts.

Asbestos Safety Guidelines in New York

In New York, asbestos safety guidelines are primarily carried out by three state agencies – the Department of Health, Department of Labor, and Department of Environmental Conservation. As with other states, New York also adheres to the National Emissions Standards for Hazardous Air Pollutants (NESHAP) guidelines published by the U.S. Environmental Protection Agency (EPA). The primary asbestos regulations protecting workers in New York are found in Title 12, Part 56 of the Official Compilation of Codes, Rules, and Regulations of the State of New York (NYCRR), and they fall under the jurisdiction of the Department of Labor. These rules and regulations contain all of the various requirements employers must follow with respect to asbestos, including licensing and certification, air sampling, work area preparation, as well as abatement, cleaning, and removal of asbestos from work sites. In addition, the Department of Health administers an Asbestos Safety Program to protect employees by offering asbestos safety training.

Asbestos Litigation in New York
When it comes to asbestos litigation, New York is one of the most active areas in the country. In particular, New York City sees so many asbestos-related lawsuits that a special court has been established to try asbestos cases: New York City Asbestos Litigation (NYCAL) court. There is a dedicated NYCAL website that gives law firms access to important documents, forms, rulings, and other materials related to asbestos litigation. Similar NYCAL cases are frequently combined to help streamline the litigation process, and cases brought by terminally ill plaintiffs who have short life expectancies are given preferential access to the court process.

Asbestos-Related Death Rankings

  • New York is the country’s fourth-most populated state. It’s also the fourth highest-ranking state in the U.S. for asbestos-related deaths.
  • An estimated 12,146 people died from asbestos-related diseases in New York between 1999 and 2013. Of those deaths, 2,253 — or roughly 18.6% — were attributed to the deadliest form of asbestos-related cancer, mesothelioma.
  • Nassau County, a suburban county on Long Island, saw 1,135 asbestos-related deaths during that 14-year period — the most out of any New York county. Erie and Suffolk counties rank No. 2 and No. 3. All three counties have an average of 75 asbestos-related deaths per year.
  • Queens County in New York City ranks at No. 4; Kings County (Brooklyn) is No. 6; New York County is No. 9; and the Bronx is No. 11 on the list of New York counties poisoned with asbestos.

Building Investigations

The New York City Department of Environmental Protection carried out a survey in the 1990s to assess the public’s risk of asbestos exposure in buildings. It found 68% of buildings in the city contained materials with asbestos. At the time, the estimated total amount of asbestos-containing materials in the city was 323 million square feet, most of which was thermal system insulation.

Over the years, business and property owners in the state have taken steps to remove the asbestos from their buildings, and New York has enacted laws and regulations to promote safe handling and removal of contaminated materials.

In 2009, however, the state launched several investigations into asbestos-abatement contractors and construction-business owners who were suspected of improper handling of asbestos, despite the known health risks.

A contractor in the Rochester area was suspected of improperly removing and disposing of contaminated materials taken from dozens of work sites, including homes, businesses, schools, and health-care facilities. Another contractor, in Queens, who worked on abatement projects for decades, was sentenced to prison and ordered to pay more than $1.5 million in restitution for violating the law.

Industrial Exposure

Mesothelioma is known as the signature asbestos-related cancer. As an occupational disease, it is preventable cancer, which makes it all the more tragic.

New York’s old shipyards, including the Brooklyn Navy Yard, are infamous for their asbestos-contamination problems.

Industrial workers who are most plagued by asbestos exposure are those who have spent years in shipyard repair, heating-systems repair, the construction and automobile industries, and the Navy.

New York Mesothelioma Lawyers

Many of the top mesothelioma lawyers practice in New York City. New York is among the most popular jurisdictions for filing mesothelioma lawsuits in the United States. The state has enacted a number of procedures and rules for handling claims to manage asbestos litigation.

Filing a Mesothelioma Claim in New York

According to a KCIC industry report, New York City was the second-most popular jurisdiction for mesothelioma lawsuit filings in 2019. That year, it handled 6% of U.S. mesothelioma claims, which include personal injury lawsuits, wrongful death lawsuits and asbestos trust fund claims.

New York is home to some of the strictest asbestos laws and regulations in the country. That’s because the state is trying to protect the public from the extensive amount of asbestos that was used throughout the state from the 1800s through the 1970s.

It wasn’t until the 1970s that the U.S. government began enacting laws and regulations to limit the use of asbestos. Implementation of these laws took time, which meant many people were still heavily exposed throughout the 1980s and 1990s.

New York is known for its rich industrial history. Factories, textile mills, power plants, manufacturing plants, and shipyards used many asbestos products on a daily basis. The workers employed at these facilities were exposed to dangerous amounts of asbestos.

Many of these workers later developed asbestos-related diseases and hired a New York mesothelioma lawyer to help them seek compensation.

For example, in 1991, a New York judge consolidated 850 cases filed by power plant workers to expedite their claims. Around the same time, two other judges consolidated 600 cases filed by asbestos-exposed workers from the Brooklyn Navy Yard.

New York military bases and shipyards are known hot spots for asbestos contamination. Military veterans in the state may file VA claims for benefits, and they have access to VA health care.

Asbestos Exposure in New York

New York is No. 5 in the U.S. for mesothelioma and asbestosis deaths. The state’s high ranking is attributed to its rich industrial and manufacturing history. New York is often called the birthplace of the asbestos manufacturing industry.

In 1858, a predecessor of the Johns Manville Corporation began using anthophyllite mined in Staten Island to manufacture asbestos insulation. Over the next century, asbestos use spread to a variety of industrial applications in New York and beyond.

Workers in New York were exposed to asbestos products in factories, manufacturing plants, power plants, shipyards, schools, and public buildings. Public housing and private homes were also built with asbestos-containing construction materials.

New Yorkers who develop asbestos-related diseases have several options in the state for specialized treatment. Some of the most renowned mesothelioma treatment centers in New York include Mount Sinai Hospital, NYU Langone Medical Center, and Roswell Park Comprehensive Cancer Center.
